The Suffolk Legislature Tuesday approved a local law -- which backers described as the first nationwide -- to ban those under age 19 from buying non-prescription cough and cold medicines containing what is popularly known as DXM, or dextromethorphan.

The measure, approved in a unanimous vote without debate, came after a half dozen youth and drug counselors testified at the Riverhead meeting, warning that abuse of the over-the-counter medicines can cause psychosis, brain damage, and even death in those from 12 to 15, who label their usage "robotripping" or "skittling."

"We're not going to stop every young person from getting high on cough syrup," said Legis. Lynne Nowick (R-St. James), who labored for two years to win passage of the measure. "But like age restrictions on alcohol, it will have a deterrent effect."

Beyond cutting off sales, Nowick hoped that the measure will help educate parents and spur action in Albany and four or five other states where similar measures are being considered.

Krista Whitman, a drug counselor and member of the Suffolk County Mental Health Coalition, said that the number of DXM abuse cases has risen dramatically in recent years, from 298 in 2000 to 479 in 2006.

Aides to County Executive Steve Levy said he is likely to sign the measure but must hold a public hearing before doing so.

The health department will be charged with enforcing the law, and anyone who intentionally sells to those under age can be found guilty of a violation and be fined $250 for the first offense, $500 for a second offense and up to $750 for further offenses.

In other action, the legislature:

Approved new contracts with county park rangers and probation officers, despite complaints from several probation retirees that they will be denied the retroactive pay hikes that date back to 2004 while they were still working, hurting their pension.

Approved moving the county's insurance and risk management unit from the comptroller's office to the department of human resources.
